These Terms apply to your access to and use of the AI generation, editing, upload, storage, browsing, and related features provided through viramuse.ai.

If we provide a Privacy Policy, subscription terms, feature-specific rules, campaign rules, or other supplemental policies, those materials form part of these Terms. If there is a conflict, the more specific provision will control unless stated otherwise.

You represent and warrant that:

- You meet the minimum age required to use the Service in your jurisdiction.

- If you are under the age of legal majority, you are using the Service with the permission and supervision of your parent or legal guardian.

- You will not use the Service for any purpose prohibited by applicable law, regulation, or platform policy.

You are responsible for maintaining accurate information associated with your use of the Service and for all activity conducted through your account, device, credentials, or access method. You are responsible for safeguarding your password, verification codes, device access, and other credentials.

The Service allows you to submit text, images, videos, audio, or other materials ("Input") and to generate, edit, transform, or receive images, videos, audio, text, or other outputs created with AI models ("Output").

You understand and agree that:

- The Service may rely on third-party AI, cloud, storage, security review, payment, analytics, and support providers to fulfill requests and operate the Service.

- AI-generated results are probabilistic and may be inaccurate, incomplete, unsuitable, misleading, or inconsistent with your expectations.

- You are solely responsible for reviewing and deciding how to use any Input and Output.

- We may impose restrictions on features, templates, styles, use cases, content types, or user permissions for legal, policy, safety, security, or operational reasons.

4.1 Your Rights and Responsibilities

You retain any rights you lawfully hold in your Input. Except for the limited rights necessary to operate the Service, we do not claim ownership of your Input.

You are responsible for all Input you submit and all Output you generate, save, export, display, or otherwise use. You represent and warrant that:

- You own or have obtained all rights, permissions, and authorizations necessary to use the Input.

- If the Input contains any identifiable person, likeness, face, voice, name, artwork, logo, trademark, or other protected material, you have obtained all required consents, licenses, and permissions.

- You will use the Output lawfully, responsibly, and in compliance with these Terms.

- You will not use the Service to infringe any third party's privacy rights, publicity rights, intellectual property rights, or other lawful rights.

4.2 Limited License to Operate the Service

While you use the Service, you grant us a worldwide, non-exclusive, royalty-free, revocable, limited license to host, store, reproduce, transmit, process, display, and use your Input and Output solely as necessary to:

- Provide, maintain, and improve the Service;

- Fulfill your requests using third-party technology providers;

- Conduct security checks, moderation, abuse prevention, troubleshooting, customer support, and compliance review;

- Display content where you explicitly choose to share or publish it through the Service.

This license does not include using your Input or Output to train our general-purpose AI models without your separate, explicit, and revocable authorization.

4.3 Limits of AI Output

You understand that Output may resemble content generated for other users and may not be unique. We do not guarantee that any Output is unique, protectable, accurate, non-infringing, commercially suitable, or fit for any particular purpose.

If your use of Output creates any dispute, claim, or risk, you are responsible for taking reasonable steps to mitigate harm, including ceasing distribution, deleting content, obtaining additional permissions, or contacting affected rights holders.

You may not use the Service to do, attempt to do, or help others do any of the following:

- Upload, generate, store, display, or distribute unlawful, infringing, fraudulent, harassing, hateful, defamatory, threatening, violent, extremist, or otherwise harmful content;

- Upload, generate, or distribute sexually explicit content, exploitative sexual content, content involving minors, or content primarily intended for sexual gratification;

- Create, distribute, or facilitate any non-consensual deepfake sexual content, non-consensual face-swap sexual content, or intimate image abuse content;

- Impersonate or create misleading content involving real persons, institutions, media outlets, governments, law enforcement, schools, financial institutions, or public figures;

- Use a real person's face, voice, likeness, or identity traits for scams, phishing, fraud, extortion, fake endorsements, fabricated statements, fake news, or deceptive conduct;

- Create misleading or false synthetic media relating to elections, politics, public policy, disasters, war, public safety, public health, or other matters of public interest;

- Use or promote the Service for undress, nudify, see-through clothing, or similar unclothing or sexualized synthetic media use cases;

- Upload third-party photos, videos, audio, works, trademarks, logos, templates, characters, or likenesses without authorization;

- Upload sensitive content involving identifiable minors, or use the Service in any way that harms, exploits, or harasses minors;

- Forge documents, IDs, certificates, contracts, tickets, invoices, qualifications, or other records, or engage in dishonest conduct;

- Bypass, disable, reverse engineer, probe, attack, scrape, overload, automate against, or otherwise interfere with the Service, its models, interfaces, moderation systems, or security controls;

- Distribute malware, spam, or abusive traffic through the Service;

- Commercialize, publish, or share content where doing so would violate applicable law, platform policy, or our rules.

To comply with applicable law, platform requirements, and safety obligations, we may use automated and human review to assess Input, Output, device activity, abuse signals, and reports.

You agree that we may, without prior notice where permitted by law:

- Reject, block, or interrupt a request;

- Restrict, hide, remove, downrank, or disable content;

- Apply labels, watermarks, disclaimers, or visibility restrictions to Output;

- Suspend or restrict access to some or all features;

- Suspend, terminate, or otherwise restrict service access tied to a device or user profile;

- Preserve relevant records and disclose necessary information where required by law, regulation, court order, platform policy, rights-holder complaint, or legitimate safety and compliance needs.

If you believe content on the Service is unlawful, infringing, deceptive, abusive, exploitative, or otherwise harmful, you may report it through any in-app reporting feature we provide or by emailing [email protected].

viramuse.ai does not currently operate as a public UGC gallery or social community product. If we later enable public posting, display, or sharing features, you must comply with any additional rules we publish for those features.

If public sharing features become available, you may not:

- Publish content you do not have rights to publish;

- Use misleading titles, tags, descriptions, or screenshots;

- Circumvent watermarks, disclaimers, visibility controls, or reporting tools;

- Harass, impersonate, defraud, or abuse others through content, comments, profile fields, or messaging features.

If the Service offers paid subscriptions, credits, premium features, or other paid services, you agree to pay the fees and charges presented to you at the time of purchase.

- Unless otherwise required by law or stated on the purchase page, fees are non-refundable.

- If you subscribe through Google Play or another third-party platform, billing, renewals, cancellations, and refunds may also be governed by that platform's rules.

- We may change pricing, packaging, features, or benefits from time to time as permitted by law.

The Service, including its software, interface design, branding, trademarks, domain names, technology, workflows, templates, and related materials, is owned by us or our licensors and is protected by applicable intellectual property laws.

Except as permitted by law or with our prior written consent, you may not copy, modify, distribute, sell, lease, publicly display, reverse engineer, decompile, or otherwise exploit any part of the Service.

If you believe content on the Service infringes your rights, please send a complaint to [email protected].

Your use of the Service is also governed by our Privacy Policy. By using the Service, you acknowledge that we may process personal data, device data, Input, Output, and related information as described in the Privacy Policy.

When you use AI features, your Input and request context may be transmitted to third-party service providers for generation, processing, security review, moderation, troubleshooting, or support purposes.

We may add, modify, suspend, restrict, or discontinue any part of the Service at any time for business, legal, policy, technical, security, or operational reasons.

We do not guarantee that the Service will always be available, uninterrupted, error-free, secure, or suitable for any particular use.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Without limiting the foregoing, we do not warrant that:

- The Service will meet your needs or expectations;

- The Service will be uninterrupted, timely, secure, or error-free;

- Any Output will be accurate, complete, lawful, reliable, or fit for publication;

- Any Output will be non-infringing or suitable for commercial use;

- Any result obtained through the Service will satisfy legal, compliance, review, or business requirements.

You must exercise independent judgment before relying on any Output, especially in commercial, public-facing, legal, medical, educational, financial, advertising, or other high-risk contexts.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICE, YOUR INPUT, YOUR OUTPUT, THIRD-PARTY CONDUCT, NETWORK FAILURE, PLATFORM ACTION, MODERATION ACTION, OR ANY INTERRUPTION OR INABILITY TO USE THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF:

- THE AMOUNT YOU PAID TO US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR

- USD 100.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

To the extent permitted by law, you agree to defend, indemnify, and hold harmless ASTRAMIND SOLUTIONS INC., its affiliates, service providers, and personnel from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:

- Your use or misuse of the Service;

- Your Input, Output, or any content you upload, generate, export, or distribute;

- Your violation of these Terms;

- Your infringement of any third-party rights;

- Your unlawful, deceptive, or abusive conduct.

If the Service maintains service records associated with your device identifier, subscription relationship, cloud history, or other identifiable service record, you may request deletion of associated device-linked data and related service records by contacting [email protected], subject to applicable legal, security, fraud prevention, accounting, and compliance retention requirements.

We may suspend or terminate access to the Service if:

- You violate these Terms or any applicable rules;

- We receive a valid complaint, legal demand, court order, or platform compliance requirement;

- Your conduct creates risk to us, other users, partners, or the public;

- We reasonably need to act to protect the Service, our rights, or legal compliance.

Any provisions that by their nature should survive termination will survive, including provisions relating to intellectual property, disclaimers, liability limitations, indemnification, and dispute resolution.

We may update these Terms from time to time to reflect changes in the Service, the law, platform requirements, or our business practices. Updated versions will become effective when posted or on the stated effective date.

If you continue to use the Service after updated Terms take effect, you agree to the revised Terms.

These Terms and any dispute arising out of or relating to these Terms or the Service are governed by the laws of the State of Florida, without regard to conflict of laws principles.

Any dispute that is not resolved informally will be brought exclusively in the state or federal courts located in or having jurisdiction over Orlando, Florida, and you consent to the personal jurisdiction and venue of those courts.
